Law No. 6493, titled "Law on Payment and Securities Settlement Systems, Payment Services, and Electronic Money Institutions," came into force on June 27, 2013, and is the fundamental legislation regulating payment systems in Turkey. The purpose of this law is to regulate the procedures and principles relating to payment and securities settlement systems, payment services, payment institutions, and electronic money institutions.
With this law that came into force in 2013, the concepts of "payment service," "payment institution," and "electronic money institution" were defined for the first time in our country's legislation. With the amendment made in 2020, the authority to regulate, license, and supervise payment institutions and electronic money institutions was transferred to the Central Bank of the Republic of Turkey (CBRT).
Cafes and restaurants use POS devices to accept credit cards, debit cards, and other electronic payment methods in their daily operations. Payment service providers within the scope of Law No. 6493 make agreements with merchants to enable acceptance of debit or credit cards.
Important Points for Businesses:
Your POS device provider must have an operating license within the scope of Law No. 6493
Payment institutions must provide "payment instrument acceptance" services within the scope of their operating license obtained from the CBRT
Working with unlicensed payment institutions may create legal risks
According to the new regulation draft, establishments offering goods and services with a payment method within the scope of payment services will need to have a special business code established by Interbank Card Center Inc.
Important MCC Codes for Cafes and Restaurants:
5812: Standard MCC code used for restaurants
5811, 5814, 5499: Codes used for other cafe and restaurant categories
These codes are used for the following purposes:
Determining interchange fees
Rewarding cardholders and campaigns
Fraud detection and risk management
Within the scope of the New Generation Payment Recording Device (YN ÖKC) usage requirement, cafes and restaurants are obligated to issue fiscal receipts when accepting payments.
Basic Obligations:
Use of EFT-POS enabled YN ÖKC
Issuing integrated receipts (for debit/credit card payments)
Transmission of daily closing reports to the Revenue Administration
According to Law No. 6493, electronic money is a monetary value issued against funds accepted by the electronic money issuing institution, stored electronically, and used to perform payment transactions.

Loyalty programs (campaigns like 5% cashback)
Modern cafes and restaurants need virtual POS systems to use online payment systems in e-commerce. For integration with platforms like Yemek Sepeti, Getir, Trendyol, Migros, and Fuudy, payment systems must comply with Law No. 6493.
